ALPS Movement GmbH - Terms and Conditions

1.    General

These Terms and Conditions (“Terms”) govern your, (the “Client”, "you") relationship with ALPS Movement GmbH, Claridenstrasse 7, 8800 Thalwil (“ALPS Movement”, “our”, “us”, or “we”) including, but not limited to, the use of the Website (https://alpsmovement.ch) (the “Website”), the use of the ALPS Movement Facilities, and/or to the purchase and use of any goods or services provided by ALPS Movement, including in-person classes, online classes, memberships, etc. If any of the clauses provided herein or by reference become illegal, invalid or unenforceable, the remaining terms and conditions will continue to have in full force and effect. 

By booking a Class, Consulting, purchasing a Membership, using the Facilities of ALPS Movement, or using the Website, you agree to these Terms in their totality including any changes or amendments and until they may be supplemented or superseded by another written agreement. If you do not agree with these Terms, you must discontinue the use of the Website immediately. Continued use constitutes acceptance of the current version of these Terms.

2.    Use of Our Website

The Website provides information about the Pilates studio of ALPS Movement, its services, class schedules, pricing, online bookings, and related content. The Website may also offer access to online classes or digital materials. You are responsible for keeping your login credentials (your username and password) confidential. If you feel your login credentials have been compromised or you have reason to believe your account is no longer private you are required to contact us immediately. You are responsible for all activities under your account. To the extent permitted by law, ALPS Movement is not liable for the unauthorized use of or access to your account and/or for any resulting losses sustained through unauthorized access to your account. ALPS Movement may suspend or delete accounts of Clients in case of misuse. You may use the Website solely for lawful purposes and in accordance with these Terms. You must not engage in any activity that disrupts or interferes with the Website or attempt unauthorized access, use, upload or transmit harmful code, malware, or automated scripts.

ALPS Movement may update, modify, or discontinue the Website or any part thereof at any time.

Links to third‑party websites are provided for convenience; ALPS Movement is not responsible for the content, accuracy, or security of external sites and does not endorse them.

3.    Services and Fees

ALPS Movement offers private and semi-private Pilates classes (each, a “Class” or "Session") primarily instructed by Alexandra (Alex) Phillips (the “Instructor”), at the studio at Claridenstrasse 7, 8800 Thalwil, Switzerland (the "Facilities"), and online via video conference (e.g., Zoom).

Teacher consulting (“Consulting”) is offered as professional development support for current and aspiring Pilates teachers and are primarily conducted by the Instructor online via video conference (e.g., Zoom). Consulting is not a substitute for formal teacher training, therapy, legal advice, or financial advice.

Unless otherwise specified, each Class will last approximately fifty minutes. Unless otherwise specified, each Consulting will last approximately sixty minutes. Participation in Classes and Consulting requires prior registration through ALPS Movement’s booking system on the Website.

Standard drop-in rates (inclusive of VAT):

  • Private class (50 minutes): CHF 165.-

  • Semi-private class (50 minutes): CHF 75.-

  • Coffee Break Pilates (9 minutes): CHF 9.-

  • Consulting (60 minutes): CHF 190.-

Prices are subject to change. The current pricing is always available on the Website.

3.1    Payment Process

All fees (for Classes, memberships, private sessions, etc.; "Fees") are invoiced monthly in Swiss francs (CHF) including applicable taxes and payable upon receipt.  Drop-in sessions are invoiced individually. All sales are final unless otherwise stated in these Terms.

All fees for Consulting are charged upon booking via credit card using Stripe in Swiss francs (CHF) including applicable taxes and payable upon receipt. All sales are final unless otherwise stated in these Terms.

3.2    Cancellation policy

Sessions may be cancelled up to 12 hours before the scheduled start time without penalty, regardless of session type (private or semi-private).

Consulting may be rescheduled up to 12 hours before the scheduled start time.

Sessions cancelled less than 12 hours prior to the scheduled start time and no-shows (collectively, "No-Shows") are fully charged, or, in case of Memberships, deducted from the Membership entitlements.

ALPS Movement may cancel Classes due to illness of the Instructor, insufficient registrations, or unforeseen events; in such cases, pre-paid Fees will be credited to you for use at a later date.

3.3    3-for-2 Intro Package

The 3-for-2 Intro Package consists of three private Sessions for the price of two. These private Sessions must be used within 31 days of purchase, whereupon any remaining entitlement shall expire. The package may be booked once per individual or group. All sales are final.

3.4    20-Session Packages

20-Session Packages are available for both private and semi-private Classes. Sessions must be used within 7 months of purchase, whereupon any remaining entitlements shall expire. All sales are final.

3.5    Annual Memberships: Concept and pricing

ALPS Movement offers annual membership options for both private and semi-private Classes (a "Membership"). Memberships are an annual commitment, billed monthly over a 12-month period ("Membership Term"). Memberships provide for an entitlement to attend a fixed number of Classes per year.

Private annual Membership rates and entitlements:

  • 1 session per week · 35 sessions per year: CHF 465.- per month

  • 2 sessions per week · 70 sessions per year: CHF 900.- per month

Semi-private annual Membership rates and entitlements:

  • 1 session per week · 35 sessions per year: CHF 210.- per month

  • 2 sessions per week · 70 sessions per year: CHF 400.- per month

The Membership entitlement is designed to account for the Swiss school holiday calendar, travel, and other planned absences. Membership sessions are distributed over 35 weeks of the year, paid over 12 calendar months. Any entitlements remaining at the end of a year will expire at the end of the year.

Memberships are personal and non‑transferable.

3.6    Annual Memberships: Fixed session times

Membership Clients train on a fixed schedule. Session times (weekday/time combination) are reserved for the Client for the duration of their Membership Term. Requests to change a fixed session time will be considered based on availability and are not guaranteed.

3.7    Annual Memberships: Additional sessions

Sessions attended beyond the number included in a Membership are charged at the standard drop-in rates unless otherwise offered by ALPS Movement. Additional Sessions are subject to availability.

3.8    Annual Membership: Cancelation

Annual memberships will renew unless cancelled by giving four (4) months’ prior written notice of cancellation as per the end of the Membership Term. Termination notices must be submitted in writing or by email to ALPS Movement. Early cancellation outside of this notice period is not available. That said, ALPS Movement may, at its sole discretion, allow for early termination in exceptional circumstances.

3.9 Consulting Package

Three-Session Consulting Packages are available for Consulting. The Consulting must be completed within 7 months of purchase, whereupon any remaining entitlements shall expire. All sales are final.

4.    Responsibility and Rights of the Instructor

Unless otherwise agreed upon, the Instructor will fulfill our obligation(s) by providing the agreed Services in the course of the Classes.

The Instructor has the right to use an assistant to fulfill their obligations.

If ALPS Movement is unable to provide a Class due to the Instructor’s illness or planned absences, the Class will be rescheduled or the relevant package or membership extended by an equivalent number of sessions. ALPS Movement endeavors to plan holidays to minimize disruption to clients.

5.    Responsibility of the Client

You confirm that you are physically able to participate in the Classes. You are responsible for disclosing any relevant health conditions, injuries, or physical limitations to the Instructor before participating in the Classes. ALPS Movement reserves the right to decline or modify a Session if the Instructor considers the participation unsafe for the Client.

Clients who are unwell are asked not to attend the Classes and to cancel in accordance with the cancellation policy set out in these Terms. If you are ill within 12 hours of a Class, you should notify ALPS Movement immediately.

You must behave respectfully towards staff members of ALPS Movement and other participants. ALPS Movement may exclude Clients who repeatedly disturb Classes or violate ALPS Movement rules.

You must wear appropriate and clean clothing.

5.1 Responsibility of the Client in Consulting

All consulting sessions are confidential. The Client is responsible for managing any sensitive data and business information shared in the consultation.

6.    Insurance and Health Insurance

You are responsible for your own insurance.

ALPS Movement is accredited by QualiCert for fitness services. You may be eligible for partial reimbursement from their Swiss supplementary health insurance (Zusatzversicherung) for private and semi-private sessions and Coffee Break Pilates. ALPS Movement cannot guarantee reimbursement, and you are advised to check directly with their insurance provider regarding their individual coverage.

7.    Limitation of Liability

Participation in Classes and use of the Facilities are at your own risk. To the extent permitted by law, all liability of ALPS Movement, the Instructor is excluded. ALPS Movement is liable only for damages caused by intentional misconduct or gross negligence.  ALPS Movement is – in particular – not liable for injuries resulting from improper use of equipment, failure to follow Instructor guidance, or pre‑existing medical conditions.

When booking a Class, you acknowledge that participation in the Classes involves certain risks and dangers that cannot be entirely eliminated. You accept these risks associated with physical activity and participation in the Classes, including those risks which cannot be eliminated regardless of the care taken to avoid injuries. You must consult the Instructor if you have any doubts regarding the proper set up or use of the Facilities. In consideration of being allowed to participate in and access the Classes, you assume full responsibility for any and all injuries, illness, or damages which are sustained or aggravated by you as a result of your participation in the Classes and/or use of the Facilities. You hereby waive to the extent permitted by law, release and forever discharge ALPS Movement, its Instructors, assistants, representatives, and all others from any and all responsibility and/or liability from illness, injury, death and/or any other damages to your person or property resulting from your participation in the Classes and/or use of the Facilities. In booking a Class you represent you have no health or physical conditions which would make participation unsafe, and that no medical professional has advised you against participation in Classes. ALPS Movement hereby advises you that individuals with chronic disabilities or conditions are at risk in participating in the Classes, and are advised against doing so without prior approval by a physician. In addition, if in the opinion of the Instructor, you would be at physical risk by attending the Classes, you will be denied access to the Classes. If you identify any outside or additional risks before, during or after participation in a Class, you agree to immediately bring such information to the attention of the Instructor.

Finally, the Website is provided “as is” and “as available.” ALP Movement does not guarantee error-free operation or uninterrupted availability of online services or the Website, accuracy or completeness of content or compatibility with all devices or browsers.

8.    Data protection

ALPS Movement and the Instructor may process and use your personal data collected in the context of Classes, bookings, and other Services or the use of the Website to perform contractual obligations and operate its business

Data collected includes contact details, booking information, and health‑related information voluntarily provided by you. Data is used exclusively for class administration, payment processing, communication with Clients, improving ALPS Movement's Services and other related business purposes.

You fully agree with the storage and contractual use of the data by ALPS Movement and the Instructor and are aware that ALPS Movement and the Instructor may be obliged and entitled by the court and disclose data where required by law or competent authorities.

Any personal data is treated confidentially and processed in accordance with applicable data protection laws. ALPS Movement does not share data with third parties except with service providers necessary for booking or payment processing, or when required by law. ALPS Movement does not disclose personal information or data to unauthorized third parties and takes reasonable measures to protect it against unauthorized access. By use of our Website, you agree and consent to our use of your data and further warrant that all data provided by you is true and correct.

You may request access, correction, or deletion of your personal data at any time.

9.    Intellectual Property

All content provided by ALPS Movement, including class materials, videos, online content, branding, text, images, graphics, logos, layout and website content, is the exclusive property of ALPS Movement and may not be reproduced, modified, distributed without prior written consent.

10.    Changes to these Terms

ALPS Movement may change and update these Terms at any time. Any changes shall be effective following publication on the Website.

12.    Accepting the Terms

Participation in any Class and the use of the Website requires acceptance of these Terms. If the Client is under the age of majority, acceptance must be given by a parent or legal guardian. By registering online on the Website, you confirm that you have read and accepted these Terms in full.

13.    Jurisdiction and Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland to the exclusion of its conflict of laws principles.

All disputes arising out of or in connection with these Terms, their validity, interpretation, amendment and termination, shall be subject to the exclusive jurisdiction of the ordinary courts of the domicile of ALPS Movement., “us”, or “we”) including, but not limited to, use of the Website (https://alpsmovement.ch) (the “Website”), use of the ALPS Movement Facilities, and/or to the purchase and use of any and all goods and services from us. If any of the clauses provided herein or by reference become illegal, invalid or otherwise unenforceable, the remaining terms and conditions will continue to have full force and effect. When making a booking or purchase, the Client agrees to these Conditions in their totality including any changes or amendments and until they may be supplemented or superseded by another written agreement.

ALPS Movement offers private Pilates classes (each, a “Class”) primarily provided by Alexandra (Alex) Phillips (the “Instructor”).

Each Class will last approximately fifty-minutes, or as otherwise designated by the Instructor.

The Classes will take place primarily at Claridenstrasse 7 8800 Thalwil, (the “Facilities”) or online using Zoom.
